Within the NHS framework, as in all care environments and services, there is a requirement for DBS checks to be undertaken for any person working in close contact, caring for or being responsible for children or vulnerable adults.

Enhanced DBS Checks for Healthcare Workers
The type of check that you apply for depends on the role that the potential employee will fill. An Enhanced DBS check is the most in-depth criminal record check and discloses all spent and unspent convictions, cautions, reprimands and warnings. Most people working in health care within the NHS framework must have an Enhanced DBS check with the barring list checked for the appropriate groups.
This means that a paediatric nurse would require an Enhanced DBS check with a List 99 Check, in order to ensure they are not barred from working with children. A doctor working with all age groups, on the other hand, would require an Enhanced DBS check with a child and adult barring list check.
DBS CHECKS FOR CARERS & NHS
Enhanced DBS checks were created to safeguard vulnerable adults and children. For this reason, anyone working closely with these groups would require an Enhanced DBS check. However, it is important to note that this advanced check’s eligibility criteria would depend on the defined job specification and responsibilities. In addition to this, the work environment and time spent in direct contact with any vulnerable person would also need to be considered.
Since checks are requested on a case to case basis, the groups which an employee will work with must be clarified before determining the type of check required. The most common roles that require an Enhanced Check include:

DBS Checks For Health Care Workers
Any health care professional who provides personal care to a vulnerable adult or child is legally required to have an Enhanced DBS Check carried out. Health care is classified as a ‘regulated’ activity and requires the highest level background check.
DBS Checks For Health Care Support Workers
Anyone working within the NHS who has only incidental contact with patients would be eligible for a Standard level DBS check. This includes maintenance, admin, domestic and catering staff. Since these positions involve little contact with vulnerable groups, this check does not cover the adults or child barring lists.
DBS Check For Health Care Volunteers
The type of check carried out for volunteers will be dependent on their role and whether or not the volunteer would be unsupervised around vulnerable groups. However, it is good to note that most volunteers will require an Enhanced Check.

Do carers need a DBS Check?
Whether you intend to work in a care home or as a home carer that works in patients’ homes to deliver care, your employers will be required to request an Enhanced DBS Check on your behalf. Depending on what your job role entails will influence whether your check should include the barring list.
How much is a DBS Check for carers?
Most healthcare organisations will pay for DBS Checks for their potential staff. As you cannot request an Enhanced Check on your own behalf, only they can request these. Some organisations require applicants to pay for their own check, but this is very rare in healthcare.
Is it illegal to work in care without a DBS certificate?
Quite simply, yes. While DBS checks, in general, are not a legal requirement, health care is a regulated activity. Therefore, employers are legally obliged to carry out the relevant checks, and will be held legally responsible if they have not.
How often do I need to renew my DBS Check in the NHS?
For most roles in which employees regularly work with vulnerable adults and children, updating DBS Checks every three years is highly recommended. While there is no legal requirement to carry out periodic checks, the certificate is fixed from the point it is issued, and will not show any new transgressions. So in order to maintain the security of your organisation, periodic updates are highly beneficial.
Can I be a care worker if I have a criminal record?
A DBS Checks’ findings do not specifically mean that you cannot fill the role you’ve applied for. An employer will need to decide whether an applicant’s criminal history will impact their ability to carry out their duties while keeping everyone safe.
This is done on a case-to-case basis, and the recruiter should take into consideration the specific circumstances. For example, if you were convicted of stealing as an 18-year-old youth, this may not be grounds to bar you from being an NHS Healthcare worker. However, if you were convicted of violence against children, it would neglible for you to be placed as a school teacher.
