What Level DBS Check Can Recruitment Agencies Ask For?
The level of DBS check that you are required or eligible for will depend on the position you are applying for. Depending on this, a recruitment agency can request that you complete the application form for a Basic, Standard or Enhanced DBS check, potentially including the barring list.
A Basic DBS check would confirm your identity and show any unspent convictions against you. This level of DBS check can be requested by your recruitment agency regardless of whether or not the role requires it.
A Standard DBS check is the next level of check and will reveal any warnings, cautions, reprimands and criminal convictions (both spent and unspent) against you.
Lastly, there is the Enhanced DBS check, which has two versions: Enhanced with and without the barring list. This level of check can only be requested if the role you are applying for specifies that you will be involved in a regulated activity. This is usually linked to working with children or vulnerable adults.

Do You Need A DBS Check For Every Job?
Not every job role requires a DBS check, as it is not always a legal requirement for a company. However, a recruitment agency can request a basic DBS check on behalf of an employer for any role.Â
On the other hand, schools, health care companies and other organisations that operate within a regulated activity need to thoroughly vet their candidates with an appropriate check before employment commences. This is often a legal requirement, and companies can be legally liable if an employee does something illegal in their role and they have not ensured that the check was done.
Can I Work While Waiting For A DBS Check?
Whether you commence employment before your DBS check is complete is at the discretion of your employer. On occasion, your current DBS check may be accepted while your updated check is pending. This should only be done when your new position is the same as your previous role. However, we always recommend an updated check is completed as DBS checks are only relevant up until the moment the certificate is issued.

Does A Criminal Record Ever Go Away?
This depends on a number of factors. Some of the activities listed in your criminal record will eventually be removed. However, how long this takes depends on factors like the severity of the charge and the individual’s age at the time of criminal activity.Â
Some activities, such as those that include violent crime or serious sexual offences, will never be removed from a candidate’s record. It is worth noting that some crimes may still be listed on a candidate’s record, but will be filtered out.
