What is a List 99 Check?
List 99 is a confidential register of people who have been legally barred from working with children by the Department of Education. Held by the Children’s Safeguarding Unit and maintained by the DBS, this list contains the names, aliases, dates of birth and national insurance numbers of all men and women who are prohibited to work with children in any setting, including schools, nurseries, colleges, social work and voluntary settings.
A List 99 Check is a disclosure request that allows organisations to check whether a potential employee or volunteer is on this list. The purpose of this check is to prevent unsuitable people from working with vulnerable groups and to safeguard children.
How Does Someone Get Added to the Children’s Barred List?
There is a broad range of reasons why someone may be added to this list, all of which focus on the safety and wellbeing of children. There are automatic inclusions as well as situations in which the circumstances will be taken into account. If, for instance, an adult is convicted of a serious sexual assault against children under the age of 16 they would automatically be placed on the Children’s Barred List.
Drug offences, violent crime and violent behaviour towards children will also likely land an adult on List 99. However, certain medical conditions and mental illnesses may be considered grounds for exclusion from this list. All additions to the list are made at the discretion of the Secretary of State for Education, so individual circumstances can be considered before someone is added to the list.

What if My Employee is on the Children’s Barred List?
If your potential employee is found to be on the Children’s Barred List, they may not work for an educational institution. Any List 99 match is legally prohibited from working with children. If someone with a List 99 record is found to be working at your educational organisation, you will be held legally liable.
Is a Children’s Barred List Check the Same as a DBS Check?
A DBS Check is different from a List 99 Check, as the latter only checks the Children’s Barred List, while a DBS Check deals with someone’s full criminal record. Both disclosures are required for anyone working with vulnerable groups, which includes children.
Therefore, you will be required to have both checks when making a potential recruitment decision. Fortunately, a List 99 Check is included in an Enhanced DBS Check, so separate requests needn’t be made. You only need to apply for a List 99 Check if you need to fill a position on short notice and cannot wait for the Enhanced Check to be carried out.
